Supporting Canadian clients with legal matters in the UAE

This page is for Canadian companies and investors working in the UAE, and for Canadians living in the Emirates. Rahman & Company advises on UAE legal matters. Canadian clients typically ask us about establishing a UAE presence, commercial contracts, employment and relocation, property, and making sure UAE assets are covered by their estate planning. We coordinate with Canadian advisers where a matter also involves Canadian tax, corporate or estate planning.

Canada and the UAE

Canadian businesses are active in the UAE in engineering, construction management, energy, education and technology, and the Canadian community in the Emirates includes many professionals and families who have settled for the long term. Canadians often arrive with contracts and estate plans built around Canadian law, which may not work as expected for UAE employment, property or assets held in the UAE. Reviewing those documents from a UAE perspective early on avoids surprises when a contract ends or a family needs to deal with UAE assets.

How we assist clients from Canada

All practice areas

Typical matters

Common UAE legal matters for clients from Canada

An engineering firm’s first UAE contract

A Canadian engineering consultancy wins a project with a UAE developer. We advise on whether it needs a UAE licence to perform the work, review the consultancy agreement for liability caps, payment and termination, and propose dispute provisions that work against a UAE counterparty.

A teacher’s contract ends early

A Canadian teacher’s school terminates her contract mid-year. We review the contract and UAE labour law to determine notice, end-of-service and any compensation due, and advise on negotiating a settlement.

A Canadian family with a Dubai apartment

A Canadian couple living in Dubai own an apartment and want to know how it would pass to their children. We explain UAE procedures, the role of a UAE will and how it fits with their Canadian wills.

These examples describe the kinds of questions clients raise. They are not case studies, and every matter depends on its own facts.

Working together

Working with Rahman & Company from Canada

  1. 01

    Initial discussion

Tell us who you are, who else is involved and what you want to achieve. A short call or video meeting is usually enough to understand the matter and agree whether we can help.

  2. 02

    Identifying the UAE legal issues

We identify which questions are governed by UAE law, which emirate, free zone or court is relevant, and where advice under the law of Canada may also be needed.

  3. 03

    Document review and strategy

Once the scope and fees are agreed, we review the contracts, licences, title documents or correspondence and set out the options and the likely next steps.

  4. 04

    Remote consultation where appropriate

Most discussions can take place by video call and email. Where a UAE step requires a signature, registration or attendance, we explain whether a power of attorney can be used and how it should be prepared.

  5. 05

    Ongoing support and coordination

We keep you informed in writing, deal with UAE counterparties and authorities on your behalf where instructed, and coordinate with your advisers in Canada.

The UAE is about eight to twelve hours ahead of Canada, depending on the province and season. Clients may be able to engage the firm remotely where this is legally and practically appropriate. Every engagement is subject to conflict, identity and compliance checks, and no particular outcome can be promised.

Questions

Frequently asked questions

Can a Canadian company own 100% of a UAE company?

For many activities, yes, either on the mainland or in a free zone.

Does my Canadian will cover my UAE property?

UAE assets are dealt with under UAE procedures. A UAE will can make it easier for your family, and we explain the options.

Can you advise on Canadian law?

Rahman & Company advises on UAE legal matters. Where advice on Canadian federal or provincial law is required, separate advice from appropriately qualified counsel in Canada may be necessary.

How do you manage the time difference?

We schedule calls early in the UAE morning or evening to overlap with Canadian working hours, and work by email in between.

Do I need to travel to the UAE to obtain legal advice?

Not usually. Most advice can be given by video call and email. Some UAE steps, such as certain registrations or court appearances, may require a properly prepared power of attorney or attendance, and we explain this at the outset. The UAE is about eight to twelve hours ahead of Canada, depending on the province and season.
